According to article 152 of the 1996 constitution, amended and supplemented, the supreme court constitutes the regulatory body for the activity of the courts and tribunals, the supreme court and the council of state ensure the unification of jurisprudence across the country and ensure compliance with the law.
The supreme court was established under law n063-218 dating from June 18, 1963, published in the official journal of the democratic and popular Algerian republic, number 43 dated June 28, 1963, it was installed on March 2, 1964.
Organic law No. 11-12 dating from 24 Chaâbane of the year 1432 corresponding to July 26, 20 It establishing the organization, functioning and powers of the Supreme Court was published in the official journal dated July 31, 2011, No. 42.
This organic law states that:
- Subject to the provisions of article 93 of the constitution, the seat of the supreme court is fixed in Algiers.
- The supreme court is the judge of law. She can act as judge on the merits in cases determined by law.
- The Supreme Court exercises control over the proper application of the law through orders, judgments and judgments and their compliance with the forms and rules of procedure.
- The Supreme Court renders its judgments in Arabic.
- The Supreme Court opens its judgments to the population as well as all legal and judicial comments and studies.
- The supreme court contributes to the training of magistrates.
- The supreme court enjoys financial and management autonomy.
The Supreme Court's appropriations are included in the state budget.
The Supreme Court publishes the “Supreme Court Review” every six months.
